Sanctions for Using the Wrong JCCR Form?
I was in discovery on January 6 when DC Bulla announced that she was considering issuing sanctions to those who use outdated joint case conference report forms beginning in February, 2015. Why? It has been updated over time and, when the old form is submitted with the wrong information, it prevents the Discovery Commissioner’s office from processing the case and issuing a scheduling order.
I do not know if these sanctions will actually come to pass, but I also do not want to be the one to find out. The current JCCR form is located here. If someone requests that you sign an old form, refuse to sign it or risk sanctions. If opposing counsel insists on proceeding, I would just file an individual case conference report with the correct form so as to avoid the sanctions.
